The British people strongly believed in the Divine Theory of State. The king was given the power to govern the people by the Divine Authority (God). Parliamentary Democracy based on the principle of equality rooted in Britain. The Rule of Law was first originated by Sir Edward Coke, the Chief Justice in England at the time of King James I. Coke was the first person to criticise the maxims of Divine Concept. He strongly believed that the King should also be under the Rule of Law. The Rule of Law doctrine was later developed by A.V. Dicey in his book, “Introduction to the Law of Constitution (1885)” The Rule of Law according to Dicey means that no man is punishable or can be lawfully made to suffer in body or goods except for distinct breach of law and no man is above the law. The term Rule of Law thus, means the paramountcy of Law over Government.
A V. Dicey opined that a government shall be based on the principles of law ;for this he introduced three pillars or three concepts that constitute rule of law. They are Supremacy of law ,equality before law and predominance of legal spirit.Supremacy of law means that all people are governed by the same law including the administrators of law and when government officials exercise powers they should be in a position to explain as to why and by what legal authority they are exercising the power. Equality before law means that all people shall be administered by the same law without any discrimination on the basis of race, religion, caste, sex, place of birth etc. this concept is envisaged in Article 14 of the Indian Constitution. Dicey believed that ultimately the judiciary enforces the law and it should be independent of any influence; so that it can give justice to people. Dicey believed that courts are enforcers of rule of law and while deciding cases they should be free from all external influences and be independent and impartial in nature.
Professor A. V. Dicey’s theory, which was so acceptable to the penchant of nineteenth-century individualism, has been a subject of critical inquiry in later years. Several fallacies have been alleged by various academicians and theorists in the findings and claims made by A.V. Dicey. Dicey stated that Rule of Law was in mind while framing the constitution while framing the constitution and this was why there was a preamble UK and that is why there was a Preamble.
